To regulate cosmetics and perfumes, Regulation (EC) No. 1223/2009 of the European Parliament and Council was adopted on November 30, 2009, known as the Cosmetics Products Regulation, which came into force on July 11, 2013. This regulation states that cosmetic products, including perfumes, must be safe under normal or reasonably foreseeable conditions of use, complying with specific composition and labeling standards. Additionally, each product must be associated with a responsible person within the European Union, ensuring traceability within the supply chain.
Recently, with the entry into force of Regulation (EU) 2024/858 of the European Commission on March 14, 2024, new measures have been introduced to strengthen the safety and transparency of these products. This regulation establishes additional requirements, including:
- Ingredient Transparency and Potential Allergens: Companies must detail all ingredients on the labeling, with clear information about potential allergens to enable informed decisions for consumers.
- Enhanced Safety Assessment: Exhaustive and documented tests are required to demonstrate that each product is safe for human use, increasing safety assessment requirements.
- Centralized Product Registration: Every product must be registered in a centralized European system, allowing for effective tracking and better oversight by authorities.
- Updated List of Restricted Substances: The regulation includes an updated list of substances prohibited or restricted in cosmetics and perfumes, adapting to scientific advances and reducing potential health risks.
Finally, both responsible parties and distributors are required to submit an information file on each product to the competent authorities. These data include the safety assessment and other product details. Additionally, products must be registered in the CPNP (Cosmetic Products Notification Portal), ensuring stricter control and higher levels of consumer protection across the European Union.
This new regulation strengthens confidence in cosmetic products and their safety, adapting to the current needs of the market and consumers.
